Terms and Conditions – Last Minute Driving Test Car Hire

1. Introduction

These Terms and Conditions outline the agreement between Last Minute Driving Test Car Hire (referred to as “we,” “us,” or “our”) and the customer (referred to as “you” or “your”). By booking driving lessons, car hire, or any related services, you agree to be bound by these Terms and Conditions. Please read them carefully before engaging our services.

2. Services Provided

We offer driving lessons, last-minute driving test car hire, and other related services through our qualified driving instructors. Services are provided by both employed and franchised instructors, each of whom operates under our guidance and is fully compliant with the applicable laws and regulations.

3. Driving Lessons and Test Car Hire

3.1. Eligibility

• You must hold a valid UK provisional or full driving licence.
• You must meet the legal age requirements to drive in the UK.
• If using our vehicle for a driving test, you must meet the eligibility criteria set by the DVSA.

3.2. Booking

• Driving lessons and car hire services are subject to availability.
• All bookings must be confirmed by us either verbally or in writing (via email, text, or other communication methods).
• We reserve the right to decline any booking at our discretion.

3.3. Lesson Duration

• Standard lessons are usually 1 to 2 hours unless otherwise agreed.
• We require a minimum of 72 hours’ notice for any changes or cancellations to avoid charges.
• Short notice driving test car hires once booked are not refundable.

4. Payments and Fees

4.1. Fees

• Our current rates for lessons and car hire are published on our website or available upon request. These rates are subject to change without prior notice.
• The fee for using our vehicle for a driving test may differ from the fee for standard driving lessons due to additional factors, such as test preparation and instructor availability.

4.2. Payment Methods

• Payment for lessons and car hire can be made via BACS transfer, debit/credit card, or cash, depending on the agreed arrangement.
• Payments are due in full before the start of the lesson or car hire. Late payments may result in a booking being cancelled or postponed.

4.3. Refunds

• Refunds will only be provided in the event of a cancellation made with at least 72 hours’ notice.
• If a lesson is cancelled by us, a full refund or alternative booking will be offered.

5. Cancellations and Amendments

5.1. Cancellation by You

• Cancellations or rescheduling requests must be made at least 24 hours prior to the lesson or car hire appointment.
• Failure to provide 48 hours’ notice will result in the full lesson or hire fee being charged.

5.2. Cancellation by Us

• Instructors reserve the right to cancel lessons in the event of unforeseen circumstances (e.g., vehicle breakdown or illness). In such cases, we will offer an alternative lesson or a full refund.
• We reserve the right to cancel a lesson if the instructor believes you are not fit to drive (e.g., under the influence of drugs or alcohol).

6. Responsibilities and Conduct

6.1. Your Responsibilities

• You must bring your valid UK driving licence to every lesson. Failure to do so may result in the lesson being cancelled and the full fee being charged.
• You are responsible for ensuring that you are medically fit to drive and that you comply with any restrictions on your driving licence.
• You must inform us of any changes to your driving licence status (e.g., penalty points or disqualification).

6.2. Instructor Responsibilities

• Our instructors will provide driving lessons to the best of their professional ability, following all relevant legal and safety standards.
• Instructors will not allow any lesson to continue if they believe it is unsafe to do so.

7. Use of Dashcams and Recording Devices

Some vehicles may be equipped with dashcams or other recording devices to enhance your training and for safety purposes. By using our services, you agree that these devices may be used during your lessons. Any footage recorded will be handled in accordance with our Privacy Policy and will only be shared with third parties where required by law (e.g., for insurance or legal investigations).

8. Driving Test

8.1. Test Vehicle Use

• If you use one of our vehicles for your driving test, you must ensure that all necessary documentation is completed and provided to the DVSA examiner on the day of the test.
• It is your responsibility to ensure that your test is booked for a suitable date and time.

8.2. Test Cancellation or Failure

• If your test is cancelled by the DVSA, we are not liable for any costs, though we will endeavour to rebook your test vehicle and any lessons around your new test date.
• In the event of a failed test, it is your responsibility to rebook lessons or the test vehicle hire for your next attempt.

9. Insurance and Liability

9.1. Insurance Coverage

• All our vehicles are fully insured for driving lessons and driving tests. This includes cover for the vehicle, instructor, and student, provided the student adheres to the terms of the insurance.
• In the event of an accident, we will follow standard insurance procedures.

9.2. Liability

• We accept no liability for personal injury, loss, or damage arising from the use of our services, except where caused by the negligence of our employees or instructors.

10. Privacy and Data Protection

11. Complaints

If you are not satisfied with any aspect of our service, please contact us directly to resolve the matter. We aim to address all complaints promptly and professionally.
